Terms and Conditions of the Store
The following Terms and Conditions define the general sales conditions applicable in our online store available at http://www.phenomene.pl, operated by Gianmarko Robert Starczyk,
STOBIECKO SZLACHECKIE 169A, Ładzice 97561, NIP: 7721971772, REGON: 100261520. The business is registered in the Central Register and Information on Economic Activity (CEIDG), maintained by the Minister responsible for economic affairs.
1. Scope of the Terms and Conditions
These Terms and Conditions apply to all orders placed through our online store. The offer of our online store is intended exclusively for Consumers.
A Consumer is, in accordance with Article 22 of the Civil Code, a natural person entering into a legal transaction with an entrepreneur not directly related to their business or professional activity.
2. Conclusion of the Agreement
The sales agreement is concluded with Gianmarko Robert Starczyk.
The presentation of products in our online store constitutes an offer to conclude a sales agreement. To conclude the agreement, you need to add the selected products to the shopping cart and place an order. The shopping cart and data entered in the forms can be modified before placing the order by using the available functionalities and messages displayed during the order process.
By clicking the confirmation button on the order summary page, you place a binding order for the products in the shopping cart. Once your order is submitted and registered in our system, a sales agreement is concluded. After placing the order, you will receive an email confirmation of the order and the conclusion of the agreement.
3. Language and Terms of Agreement Retention

The sales agreement can be concluded in Polish, English, or German.
The content of the agreement is not retained by us.
4. Product Delivery
In some cases, additional shipping costs may apply to the product prices. The ordered products are delivered by courier companies cooperating with us. Detailed information about available delivery methods, delivery times, and shipping costs are provided during the order process and in a dedicated information tab on our store’s website.
The products offered in the store are sold only through shipping. Unfortunately, there is no option for in-store pickup.
5. Payments
The following payment methods are available in our online store:
Cash on delivery upon receiving the shipment.
Electronic payments (e-payments) via the online payment service.
Traditional bank transfer to our store’s bank account. If you choose this payment method, we will send you the payment details via email after placing the order. The order will be processed after the full required payment has been received in our account.
Detailed information about available payment methods, including integrated e-payment services and potential additional costs, is provided during the order process and on the store’s website in a special information tab about payment methods.
6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal in accordance with the information provided in the withdrawal instruction. The right to withdraw from the agreement also applies to individuals concluding an agreement directly related to their business activity, if the agreement does not concern their professional activity, especially based on the subject of the business activity published in the Central Register and Information on Economic Activity.
7. Retention of Ownership
The ordered products remain our property until the full payment of the sale price has been made.
8. Damage During Transport
In the case of consumer purchases at a distance, our store always bears the risk of accidental damage or loss of goods during transport. If the ordered products are delivered with obvious damage caused during transport, please report this defect to the delivery person as soon as possible and contact us. Delayed reporting of such a complaint or contacting us does not affect your statutory rights (described below in the complaints section) and their satisfaction. However, early reporting helps us pursue claims against the carrier or transport insurer.
9. Complaints: Conformity of Goods with the Agreement / Defects
We are obliged to deliver goods without defects. In case of non-compliance of the goods with the agreement, the Consumer is entitled to the rights specified in Chapter 5a of the Consumer Rights Act. Under the conditions outlined there, the Consumer can demand repair or replacement of goods that do not comply with the agreement, or submit a declaration to reduce the price of the goods or withdraw from the agreement.
We are responsible for the lack of conformity of the goods with the agreement disclosed within 2 years from delivery, unless a longer expiration date has been specified for the given product—then this longer period applies.
In case of non-compliance of the goods with the agreement, the above provisions regarding the Consumer also apply to individuals entering into an agreement directly related to their business activity, provided that the agreement does not concern their professional activity based on the subject of their business activity published in the Central Register and Information on Economic Activity.

Our customer service is available from Monday to Friday from 8:00 AM to 4:00 PM.
10. Services Provided Electronically
To use our online store, including browsing the assortment and placing orders, you need a multimedia device with an installed web browser and access to the internet and email. It is recommended to enable JavaScript support and allow cookies in your browser settings. Users are obliged to use the online store in accordance with the law and good customs, and it is prohibited to provide unlawful content.
We take all necessary actions to ensure the proper functioning of our online store’s service and interface within the limits of current technical knowledge and undertake to resolve any reported issues and technical problems within a reasonable time. This also applies to the possibility of subscribing to the newsletter or creating a customer account—if these services are provided by our store. You can report any technical problems or service interruptions via the contact details provided above. In complaints related to technical issues, please indicate the nature and date of the issue.

12. Provisions on Using Trusted Shops Buyer Protection
Through the Buyer Protection provided by Trusted Shops SE, you can secure orders placed with us for free, up to a maximum amount of 10,000 PLN. The conditions for Buyer Protection can be found here. Buyer Protection is activated by clicking the appropriate button on the Trustcard tool window, which appears as a pop-up on the thank-you page after placing an order in our store. To offer Buyer Protection, Trustcard must access order data stored in your browser’s cache. This access is local, and no order data is transferred to Trusted Shops unless you actively choose to opt for Buyer Protection or consent to the transfer of order data to Trusted Shops. If you consent, your email address hash, order number, and order amount will be sent to Trusted Shops. If you are already registered with Trusted Shops for Buyers, your order with us will automatically be covered by Trusted Shops’ guarantee. If you are not yet registered, you can sign up via the Trustcard as described above. 13. Out-of-Court Dispute Resolution
We inform you that Consumers have the right to use out-of-court methods of handling complaints and pursuing claims. Information on how to access these procedures can be found at: www.uokik.gov.pl under the “Out-of-Court Consumer Dispute Resolution” section.
Additionally, at: http://ec.europa.eu/consumers/odr, Consumers have access to an online platform for out-of-court consumer dispute resolution (ODR platform). The ODR platform is a multilingual, interactive website for Consumers and businesses seeking an out-of-court resolution of disputes arising from the conclusion of remote sales contracts or service contracts.
Using the above-mentioned out-of-court methods of dispute resolution is voluntary and can only take place if both parties (the Consumer and the seller) agree.
None of the provisions of these Terms and Conditions aim to infringe upon the statutory rights of the Consumer. In the event of any discrepancies between the provisions of these Terms and Conditions and the Consumer rights resulting from universally applicable regulations, the statutory regulations will always take precedence.
